The Town board of the Town of Clayton held a regular meeting at the Village Municipal Building with the following present: Robert W. Cantwell Jr., Justin Taylor, Donald I. Turcotte, Bob Boulton , Kathy LaClair, Jim Yuhas, Nicole Cornaire, Bud Baril, Sharie Derrickson (TI Sun), Michael Docteur, Leslie Drake, Jasper R. Wilkie, Bill Udart Supervisor Cantwell opened the regular meeting at 5:00 PM. Correspondence: - Judge Clarence Giles December 2006 report. (See attached.) - Judge Clifford James December 2006 report. (See attached.) - Received December 2006 copy of Northern Regional Center for Independent Living “Focusability”. (See attached.) - Received Town of Clayton Fire District meeting minutes for Dec. 2006 and Agenda for Jan. 10, 2007. (See attached.) - Received from Sandy Taylor of Tug Hill information on the 18th Annual Local Government Conference scheduled for Thursday, March 29, 2007 at JCC in Watertown. (See attached.) - Received a mailing from “Water Is Life” Committee. (See attached.) - Received letter dated 12/29/06 from Les Drake concerning training of Planning and ZBA Board members. (See attached.) - Received letter dated 12/28/06 from Les Drake stating interest of a position of Assistant Town/Village Zoning Enforcement Officer. (See attached.) - Letter dated 12/29/06 from NYSERDA welcoming Town of Clayton as a participant in the “NY energy $martK New Construction Program”. They’ve set aside funds to provide an incentive award of $46,023 to implement selected electric energy efficiency improvements for Recreation Park Arena. (See attached.) - Received January 2007 copy of Grants Action News. (See attached.) - Received copy of letter from Menter, Rudin & Trivelpiece, Joseph Russell Atty. To Donald Canfield, Director of Jefferson County Planning dated 1/9/07 advising of action taken concerning the town of Clayton Zoning Amendment/Wind energy Facility Overlay district & Local Law #1 of 2007. (See attached.) - Letter dated 1/5/07 from 1000 Islands Land Trust advising of their successful application and they will be receiving funds through the Recreational Trails Program. (See attached.) - Received the “Return Receipt” dated 1/8/07 from State of New York Dept. of State for filing of Local Law #1 of 2007. (See file.) - Received Depauville Sewer district minutes from 1/5/07. (See attached.) - Received January 2007 issue of Friends Focus from Hawn Memorial Library. (See attached.) - Received from Jefferson County Treasurer copy of the 2006 payments made to the Town of Clayton. (See attached.) Points of Interest: - Village of Clayton proposes that they will pay our expenses for temporary offices and charge the Town rental fees. - Correspondence also received from NYSERDA indicating the Town is eligible for funds for the Chiller replacement at Recreation Park. New Hire Recreation Park: Motion by Donald Turcotte, 2nd by Justin Taylor, to hire R.J. Sherman full time at Recreation Park Arena starting 1/4/07 at $10.00 per hr. Motion carried. Kittle & Rose -Absent. Minutes: Motion by Justin Taylor, 2nd by Donald Turcotte, to approve December 27, 2006 minutes as written. Motion carried. Kittle & Rose – Absent. Minutes of January 3rd, Annual Meeting will be held until January 24th meeting. Resolution: Resolution No. 27of 2007 offered by Justin Taylor, 2nd by Donald Turcotte, authorizing the Supervisor to execute an agreement between the Towns of Clayton & Orleans to enter into a municipal agreement to create a coordinated assessment program. Motion carried. Kittle & Rose – Absent. Public: Legislator Docteur stated he is looking to work together with St. Lawrence Co. concerning jail expansion and Jefferson County mutual over crowdedness. Also a possibility working together with medical & training officers. Another problem is looking for other forms of punishment other than incarceration. He indicated that there are some issues at the County Airport on the horizon. The County is looking at Big Sky to do a maintenance center at our location. He will be attending NYSAC the end of this month. Sharie Derrickson stated the TI Sun is sponsoring an open forum on March 29th at 6 PM, location yet to be determined. The open forum will be with Bob Freeman and topic is Open Government. Supervisor Report: Motion by Donald Turcotte, 2nd by Justin Taylor, to approve the Supervisor’s report as presented. Motion carried. Kittle & Rose – Absent. Bills: Motion by Donald Turcotte, 2nd by Justin Taylor, to approve paying Abstract #1, in the amount of $218,380.50 for voucher #1 thru #82. Motion carried. Kittle & Rose – Absent. Frink Report: Supervisor Cantwell gave an updated report concerning the grants received and the agreements and contracts in regard to the Frink Development project. (See attached.) Opera House Renovation Project: Supervisor Cantwell gave an updated report concerning the grants received and the agreements and contract in regard to the Opera House Renovation Project. (See attached.) Wind Energy: Supervisor Cantwell indicated that a letter from Joe Russell, Atty. did go to the Jefferson County Planning Dept. and was received by them concerning Local Law #1 of 2007. Atty. Russell is currently reviewing an escrow agreement with PPM. PPM submitted an application yesterday (January 9, 2007). Receipt for Local Law #1 of 2007 was received back from Albany date stamped January 8, 2007. Planning Board will meet tomorrow night. They will establish Lead Agency for SEQRA and establish a workshop meeting to come up with a game plan, such meeting will include Atty. Russell and PPM. Discussions with Atty. Russell have indicated need for a Consulting engineer to be on board right away. Board discussion indicated that Bernier, Carr & Associates was consultant for Martinsburg and worked on structural review of Town & County roads, also worked on visual and sound mitigation. They would obtain other qualified consultants when needed. Motion by Justin Taylor, 2nd by Donald Turcotte to appoint Rob Campany & Bernier, Carr & Associates as lead consulting engineer of record on the wind turbine application. Motion carried. Kittle & Rose – Absent. Motion by Donald Turcotte, 2nd by Justin Taylor to appoint Atty. Joe Russell and Menter, Rudin & Trivelpiece as special counsel in connection with the wind turbine application. Motion carried. Kittle & Rose – Absent. Discussions followed concerning allocating more money for an Assistant ZEO or Clerk to help with paperwork in connection with the wind turbine application. Highway Report: - Spoke with Mark D. Nadolny, Project Engineer from CME out of Albany today in connection with traffic flow and road conditions related to the Wind Energy Project. - Liner on the new trailer is done. - Looking to do a road exchange with the County whereby the Town receives Co. Rtes: 128, 125 & 10. We would turn over the Depauville/Brownville Rd. - Looking to rebuild the Wood Road this year. - With the good weather, we’re still doing cold patching and sign repair. - This coming season we will be doing Strawberry Lane/Brooks Drive for the Village. Committee Reports: Justin Taylor - Received a phone call from the Watertown Times Albany correspondent concerning an article he was doing about medical coverage for working personnel. - GIS – waiting for email back from the Contractor. - Have reviewed briefly several laws that affect towns that were passed in 2006. Donald Turcotte - Attended last Fridays Sewer Meeting in Depauville. - We are hoping to negotiate with the DEC to go from 5 years to 6 years for pumping sewer tanks. - Recreation Park, the roofs will be put on the dugouts shortly. - The chiller is substantially completed at Recreation Park. Some minor punch lists remain. - Heritage Heights Sewer still has problems. BCA, Bach and Supt. Boulton will meet tomorrow morning at the site. The pumps are not working properly. - Advertisement for a part-time laborer at Recreation Park will be in tomorrows TI sun. Next Meeting: Workshop meeting will be 1/24/07.
