November 14, 2007

The Town Board of the Town of Clayton held a regular meeting at the Town Board Room, 405 Riverside Drive, Clayton, New York with the following present:

Supervisor Taylor opened the meeting at 5:00 PM.

 

Public:

Mike Docteur, County Legislator stated he is working on a committee to negotiate a Payment In Lieu Of Taxes (PILOT) for the Wind Turbines and is hoping to work together with the Town on this project.

 

Mr. Docteur stated he had attended a Jail Committee meeting today.  When there is something accomplished he will let us know.

 

In answering a question from the Board, Mr. Docteur stated nothing further has happened on three phase power.  One company hasn’t completed their paperwork yet.  We’re just waiting for the company to get the paperwork done and submitted.

 

Cindy Grant thanked the Board for aiding in the bus tour to Maple Ridge.  Mrs. Grant believes a bus tour for the Horse Creek area should happen.  Many people who have lived here many years don’t know where this is located.  There are still many people in this area who don’t know what is being proposed and she believes the Town should do another mailing to get them informed.

 

Gus Withington from Bernier, Carr and Associates, LLC stated that their firm is assisting the Town of Clayton in reviewing the Draft Generic Environmental Impact Statement that was submitted by PPM Energy.  The firm advertised for a Wind Noise Expert and has received two (2) applications.  They have requested from Cavanaugh Tocci Associates, Inc a proposal to assist the town in evaluation.  (See attached.)

 

Ms. Withington stated that PPM was advised of Cavanaugh Tocci Associates, Inc as the 3rd party analysist this afternoon and PPM is acceptable to them.

 

The Town Board by consensus endorses this vendor.  The Planning Board is empowered to find a 3rd party perspective and no further action is required by the Town Board.

 

Town West Side Sewer District:

Supervisor Taylor indicated that this district is east of Bartlett Point Road and North of NYS Route 12E.  To update the Board, Supervisor Taylor indicated that the Village will have their contractor estimate running laterals down Bartlett Point Road, across South Shore Road and having a manhole at Bartlett Point Road.

 

Route 12 Feasibility Study:

Supervisor Taylor indicated that the proposed Route 12 Village of Clayton line to Fisher’s Landing Sewer Feasibility Study Grant of $7,000 is progressing.  Everything is lined up to get the 50% portion of $3,500.

 

Depauville Community Center Bids:

Gus Withington stated the bid advertisement should be in this weeks TI Sun and bids are requested to be in the Town Clerk’s Office by 12/5 at 4 PM and they will be opened here at that time.

-                      Notice of application deadline of February 2008 for Local Government Records Management Improvement (LGRMIF) Grant funding for the upcoming year.  (See attached.)

-                      Received 11/2/07 from NYSERDA a brochure regarding Code of Conduct for Contractors, Consultants and Vendors to ensure a business relationship that is consistent with ethical business practices.  (See attached.)

-                      Association of Towns notice of annual meeting & training in NYC will be February 17-20, 2008.  Town of Clayton’s dues will be $1,000 payable in January of 2008.  (See attached.)

-                      Business With  A Twist is tomorrow night (11/15/07) Thursday from 5-7 PM at Karla’s Christmas Shopee.  (See attached.)

-                      Land Use Planning Workshop notice for Advance SEQR training sessions at JCC.  This is a free workshop – must RSVP by 11/26/07.

-                      Listing of fall grant application information sessions from the NY State Archives.  (See attached.)

-                      Resignation of Assistant ZEO has been received and filed in my office on 11/8/07.  (See File.)

-                      Received information on 11/8/07 from Barb Harter, Bus Coordinator for the NYS Association of Towns Conference (2/17/08 – 2/20/08) in NY City.  (See attached.)

-                      Received a letter from the Village board (11/9/07) concerning Village of Clayton Wastewater Treatment Collection Prioritized Project Plan Stakeholders Workshop on 12/1/07, which is a Saturday starting at 9 AM.  You need to RSVP to the Village by 11/14/07.  (See attached.)

-                      Depauville Sewer District Meeting Minutes of 11/9/07 have been received.  (See attached.)

-                      Received Grants Action News of 11/7/07.  (See attached.)

 

 

RESOLUTION #46 of 2007:

Offered by Donald Turcotte, 2nd by Lance Peterson, to authorizes a joint application with the CLDC for a NYS DOS Coastal Resources EPF LWRP planning grant with the CLDC as Lead.  Taylor – aye; Kittle – aye; Turcotte – aye; Peterson – aye; Baril – aye.  Motion Carried.  (See Resolution Book.)

 

Part-time Laborer – Recreation Park:

Motion by George Kittle, 2nd by Donald Turcotte, to hire Karen Goetz part-time at Recreation Park for the date of 11/12/07 at $8.00/hour for eight (8) hours.  Motion carried.

 

Supervisor’s Report:

Motion by George Kittle, 2nd by Donald Turcotte, to approve the Supervisor’s Report as submitted.  Motion carried.

 

Budget Transfers:

Motion by Lance Peterson, 2nd by Paula Baril, to approve the transfers as presented.  Motion carried.

 

Bills:

Motion by Lance Peterson, 2nd by Paula Baril, to pay Abstract #11 in the amount of $243,203.32.  Motion carried.

 

Board of Assessment Review:

Supervisor Taylor stated the B.A.R. had met to discuss 801 housing and Melfi discussions.  There have been no challenges to any of the decisions.  The Assessor can go back three (3) years to collect back Fire District Tax money.

 

Revaluation was also discussed.  A mailing will be going out to any parcel that has had a change.

 

Supervisor Taylor stated he has had discussions with a potential candidate to fill the vacancy on the B.A.R.  Supervisor Taylor is waiting to hear back from the candidate.

 

Assistant Zoning Enforcement Officer:

Steve Dorr has tendered his resignation.  Supervisor Taylor has discussed this with the Mayor and Deputy Mayor.

 

The Town will re-advertise for someone to either take the position as assistant and someone to do Codes or a combination of doing both jobs.  The ad will appear in next Wednesday’s TI Sun.

 

CLDC & Frink Notes:

Supervisor Taylor stated he had distributed CLDC and Frink Notes to the Board from the last meeting.

 

Recreation Park -Tables & Chairs:

Board discussion concerning purchasing additional tables and chairs for Recreation Park.  On occasion these have been lent out.  Discussion on starting to collect a fee per item lent out.  No final decision made.  Board will discuss in the future.

 

Adopt 2008 Budget:

Motion by George Kittle, 2nd by  Donald Turcotte, to approve the 2008 Town of Clayton Budget.  Motion carried.

 

Highway Report:

-                      Strawberry Lane:     Road work is done.  All paved.

                                             Some sidewalk left to be done.

                                             Work behind curb needs to be completed.  Dress up                                                      some of the yards; top soil & grass.

-           Medical Center:       Will be starting their project soon. Met with Verizon                                                        & National Grid (updating three phase wiring).

                                             Area speed zone will be addressed.

-           Frink Development: Winding down for this year.  Back fill material is                                                   stock piled.  Four small excavations have been done                                                 and two are back filled now.  We’re waiting on                                                       samples from the other two sites before they can be                                                       back filled.  Need to level the area up some and work                                       on some of the fencing.  Within a week to week and                                                          a half of work left to do for now.

-           Road Exchange:        Spoke with Jim Lawrence, County Highway                                                                   Superintendent.  We’re all set with our exchange.

-           Loader:                      Break down problems (bent plate). Got tow (2)                                                quotes for repairs:  Anderson’s $10,000 & Tracey                                                      $13,000.  Motion by Lance Peterson, 2nd by Paula                                                Baril, to put this 644 John Deere loader out as/where                                                    is for a minimum of $10,000.  Motion carried. 

                                              Looking at a State Bid four (4) yards loader this year. 

                                              120-150 days out @ approx. $135,000 – possibly                                                       rent to purchase.

-           Sander:           Will advertise for a new stainless steel sander.

-           Depauville Community Center:  Bid opening 12/5/07.

                                                           Has the signs – waiting to put up.

Committee Reports:

 

            Donald Turcotte:        Roofs are on the dugouts.

                                                Depauville Sewer Board meeting was last Friday.  No more                                          meetings until Spring unless there is a problem.  Need two                                                         (2) members as Bill Udart is very ill & Norm Seymour                                                          doesn’t attend meetings.

                                                Talked with Connie Haver the Library has a $61,000                                                    shortfall after insurance reimbursement.  We need to                                                      contact Sen. Wright to see what he might be able to do.

 

            George Kittle:            Ken Knapp letter received and well written.

                                                TIERS – We shouldn’t be on stand by for the                                                               municipalities that don’t want to contribute financially.

 

            Lance Peterson:         Nothing to report at this meeting.

 

            Paula Baril:                Requested the Highway Superintendent erect a sign on                                                  Reese Road at both ends (Co. Rte. 10 & 5).

                                                TIERS – With the holidays approaching a nice gift to                                                     someone is either a safeguard membership or a 911 sign.
